OVI Lawyer in Warren, Ohio

Trumbull · Mahoning · Ashtabula

In Ohio, a DUI is called an OVI: operating a vehicle while impaired. An OVI arrest can put your license, your job and your record at risk, and the clock starts the day you’re arrested. As a former prosecutor, I know how these cases are built, from the traffic stop to the breath test.

Act Fast: Your License Is Already Suspended

If you failed or refused a breath, blood or urine test, the officer likely gave you an Administrative License Suspension (ALS) on the spot. That suspension starts right away, before you’ve been found guilty of anything.

  • First-offense test failure: 90-day suspension

  • First-offense refusal: 1-year suspension

  • You can challenge the ALS at your first court appearance, or within 30 days after it

That’s why it helps to call me before your first court date.

What I Look At

  • The stop. Did the officer have a legal reason to pull you over?

  • The field sobriety tests. Were they given and scored the way the training requires?

  • The breath or blood test. Was the machine certified and maintained? Was the 20-minute observation period followed? Was the sample handled correctly?

  • The video. Dash-camera and body-camera footage often tell a different story than the report.

  • Your rights. Were you properly advised before the test and before questioning?

Possible Penalties for a First OVI

Every case is different, but a first OVI conviction in Ohio generally carries:

  • At least 3 days in jail or a 72-hour driver intervention program

  • A fine of $375 to $1,075

  • A court license suspension of 1 to 3 years, with limited driving privileges often available

  • 6 points on your license

  • Higher minimums for a test result of 0.17 or above

Penalties increase for repeat offenses within 10 years. An OVI conviction cannot be sealed in Ohio, so the outcome of this case matters.

Possible Outcomes

Depending on the evidence, options can include suppressing the test or the stop, a dismissal, a reduction to a non-OVI offense such as reckless operation, limited driving privileges, or trial. I’ll tell you honestly which ones are realistic in your case.

Related Charges

Physical control (being in the driver’s seat while impaired), driving under OVI suspension, test refusal with a prior, and underage OVI.
